German Regulators Issue Updates for Financial Sector Entities

    March 04, 2022

German regulatory authorities published the frequently asked questions on the Risk-bearing Capacity Information Ordinance, a consultation on external bail-in implementation, and a report that sets out risk BaFin will focus on addressing in 2022.

Below are the key details of the recent updates:

    • Deutsche Bundesbank published the frequently asked questions about reporting risk-bearing capacity information, in accordance with the Financial and Risk-bearing Capacity Information Ordinance (FinaRisikoV).
    • The Federal Financial Supervisory Authority of Germany (BaFin) launched the Consultation 01/2022 that sets out the revisions with respect to the external bail-in implementation in Germany, with the comment period ending on April 15, 2022.
    • The “Risks in BaFin’s Focus” report from BaFin identifies six key risks to the financial sector in Germany and informs that BaFin intends to deal with these risks in 2022. These six risks are risks caused by the low interest rate environment, risks caused by corrections on the real estate markets, risks caused by significant corrections on the international financial markets, risks caused by corporate loan defaults, cyber risks, and risks caused by inadequate money laundering prevention. In the report, BaFin outlines its assessment of the current risk situation and explains the steps it is taking to mitigate the risks to the financial markets. In doing so, it intends to make progress toward its medium-term objectives for 2022 to 2025.
