BaFin Proposal on Information Transmission for Qualifying CCP Holding
BaFin published a draft circular about the publication of the list of the information to be transmitted with a view to the acquisition, increase, reduction, or sale of a qualifying holding in a central counterparty (CCP). BaFin is issuing a consultation regarding this and the consultation period ends on July 30, 2017.
Article 32 (4) of the European Market Infrastructure Regulation (EMIR) stipulates that each EU member state shall determine the information to be communicated to market participants by the relevant supervisory authorities when they wish to acquire, increase, reduce, or dispose of qualifying holdings in a central counterparty. This list of information to be transmitted is necessary for the relevant supervisory authorities of the central counterparties to be able to make an assessment according to Article 32 EMIR.
