CBRC Solicits Opinions on Rules on Entrusted Loans of Commercial Banks
CBRC is soliciting opinions on the Management Rules of Entrusted Loans of Commercial Banks. The rules are intended to further standardize the management of entrusted loans and promote sound development of entrusted loan businesses of commercial banks. CBRC will make further revisions based on feedback received and issue the rules at an appropriate time.
The rules include 5 chapters and 34 articles. The first chapter on general principles clarifies the scope, definition, and principles of entrusted loans. The second chapter on business management covers standardizing preconditions for application, capital sources, capital usage, contract requirement, and account management of entrusted loans. The third chapter on risk management puts forward management requirements in multiple areas, including capital examination, authorization management, financial calculation, information reporting, and business inspection. The fourth chapter on legal responsibility proposes supervisory measures and penalties by CBRC on banks with misconduct, while the fifth chapter constitutes the appendix that defines the right of interpretation and the time to implement.
