ESMA updated questions and answers (Q&A) documents on the implementation of European Markets Infrastructure Regulation (EMIR), Short Selling Regulation (SSR), Benchmarks Regulation (BMR), and Central Securities Depository Regulation (CSDR). The Q&A mechanism is a practical convergence tool used to promote common supervisory approaches and practices. It is intended to help investors and other market participants by providing clarity on the requirements.
The updated Q&A include the following:
- Q&A on EMIR—A new answer in relation to operational aspects of access to the trade repository data
- Q&A on SSR—An update of the Q&A on uncovered short sales, further specifying cases in which rights to subscribe for new shares cannot be used to cover a short sale
- Q&A on BMR—Two new answers related to commodity benchmarks and clarification of the cases in which a benchmark is used to measure the performance of an investment fund
- Q&A on CSDR—Four new Q&A on topics including ancillary services, general organizational requirements of CSD, and prudential requirements on operational risk
