    BaFin Circular on Reporting of Information on Resolution Planning

    BaFin published Circular 9/2019 (A) on reporting of information on resolution planning. The circular describes the administrative practice of the BaFin related to the Implementing Regulation (EU) 2018/1624, which lays down implementing technical standards on procedures, standard forms, and templates for the provision of information for the preparation of resolution plans for credit institutions and investment firms. The circular is addressed to all institutions and groups for which BaFin is directly responsible as the national resolution authority.

    Institutions or groups under the responsibility of SRB are outside the scope of this circular. For them, only the requirements published by SRB apply. The circular stipulates that BaFin must individually inform all institutions and Union parent companies what information they have to submit. In case an institution or a parent company has not been informed, it can assume that no information and no forms are to be provided. The associated implementing regulation of EU sets out the timeline and format for the information to be provided by institutions and Union parent companies. Article 3(1) of the implementing regulation provides that the information required in the notification forms set out in Annex I to the implementing regulation must be provided. In addition, BaFin may request further information that is not contained in the registration forms (Article 7 implementing regulation).
