BaFin Consults on Minimum Requirements for Feasibility of Bail-In
BaFin published a circular and a consultation (02/2019) on the minimum requirements for the feasibility of a bail-in. Comment period ended on March 01, 2019. The circular describes requirements for information to be provided and to be kept available for the implementation of the resolution tools of participation by the holder of relevant capital instruments and the creditor.
In the context of resolution planning, the resolution authority must examine the resolvability of institutions and groups. This includes examining whether a selected resolution strategy is feasible and whether there are potential grounds for refusal. Among other things, it must be examined whether the
- management information systems are able to provide the information that is essential for the effective implementation of the institution at any time, even under rapidly changing conditions
- institution is able to provide the information necessary to determine the amount of the required write-down and/or recapitalization
