ESMA published a guidance note on the process for registering securitization repositories under the Securitization Regulation. The note includes information related to timing of application, format and submission of application, acknowledgment of receipt of the application, assessment of completeness, requests for additional information, notification of completeness, assessment of compliance, notification of the decision, and registration fees.
The note highlights that if an applicant is already registered under European Market Infrastructure Regulation (EMIR) or Securities Financing Transactions Regulation (SFTR) and intends to also register under the Securitization Regulation, it must apply for an extension of registration. This note does not address issues related to substantive examination of the conditions for registration and does not provide guidance on how to meet the conditions for registration. According to Article 10(1) of the Securitization Regulation, companies need to be registered with ESMA to perform securitization repository activities.
